Trademark Registration in India: A Practical Starter Guide

From clearance search to registration certificate — the essential steps to protect your brand under the Trade Marks Act.

A trademark distinguishes your goods or services from those of others. Registering it in India grants exclusive rights, statutory protection, and a valuable business asset.

The process begins with a clearance search of the Trade Marks Registry to ensure your mark is available and not confusingly similar to existing marks. Next, you select the correct class (or classes) under the NICE classification that covers your goods and services.

You then file the application (Form TM-A) with the appropriate details and specimen. The Registry examines the application, and if objections arise, you respond to the examination report. Accepted marks are advertised in the Trade Marks Journal, opening a window for third-party opposition. If unopposed — or if opposition is overcome — the mark proceeds to registration, valid for ten years and renewable indefinitely.
